This is an appeal by the People (pursuant to Pen. Code, Â§ 1238, subd. (a)(3)) from an order granting defendants motion for a new trial. The order was made after a jury returned a verdict finding defendant guilty of four counts of first degree robbery with an additional finding of the use of a firearm within the meaning of Penal Code section 12022.5. After the verdict, defendants retained counsel was relieved and the public defender was appointed in his place. Evidence was taken at a hearing on the motion for a new trial. The court granted the motion on the ground that the defendant had been denied effective representation by counsel within the meaning of the Sixth and Fourteenth Amendments of the United States Constitution because trial counsel had failed to adequately investigate the case prior to trial.
